Waiver and Warnings for Gator Rental
WAIVER OF LIABILITY, WARNING AND RULES
FOR GATOR RENTAL AT Whiterock ResotyThe John Deere Gator can be a dangerous vehicle, and the biggest dangers are tipping the vehicle over, vehicle runaway, throwing a passenger and being struck by another vehicle on the road. Any of these risks, and others unnamed, can cause significant injury or even death.
The undersigned hereby acknowledges and accepts these risks on behalf of everyone in the rentors party, and agrees to hold Whiterock Resort and its employees free of all liability for this dangerous activity. The rentor assumes all inherent risks for participating in this activity, and does this on behalf of everyone in the rentors party.
In order to minimize risks, the rentor and all others should follow these rules:
The Resort prohibits drivers younger than 18, unless accompanied by an adult. Also, be advised that the manufacturer warns that no one younger than 16 should drive the Gator, given their strength and experience. If you permit anyone younger than 16 to drive, you do so at your and their own risk.
Stay on the main trails, and avoid rough or sloped terrain. When going down steep parts of the trail, or traversing rough parts of the trail, go very slowly.
The manufacturer warns that no passengers should be carried in the cargo box. If you choose to ignore this warning, you do so at your own risk. If you carry passengers in the cargo box, make sure that all cargo passengers have their "bottom on the bottom" to keep their center of gravity low. Also, make sure the tailgate is up to prevent anyone from sliding out, do not permit cargo passengers to lean against the tailgate and drive with extreme caution.
Do not drive on any public roadway, except when accessing the trails near the River House. Before crossing the roadway or the bridge, use extreme caution and listen as well as look for roadway traffic.
The rentor is responsible for all damage to the Gator which is incurred during the rental. All repair bills will be submitted to and paid for by the rentor. Before renting the Gator, the rentor and an employee of Whiterock Resort will together inspect for any damage to the vehicle incurred before the rental.
To minimize the risk of damages:
Stay on the Main Trails.
Do not let children drive the Gator.
Do not drive at excessive speeds.
Avoid driving under Honey Locust trees, whose thorns cause flat tires. If you get a flat tire, walk back to the River House. Do not drive on the rim.
